Terms of Use (EULA)

These Terms of Use and End User License Agreement govern your use of GoMind, a mind mapping application operated by Posh Limited, a company registered in Hong Kong. By downloading, installing, accessing, or using GoMind, you agree to these terms.

1. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use GoMind for creating, editing, storing, syncing, and exporting mind maps, subject to these terms and applicable app store rules.

2. Ownership

GoMind, including its software, interface, design, trademarks, and related materials, is owned by Posh Limited or its licensors. You retain ownership of the mind maps and content you create with GoMind.

3. Paid Plans and Subscriptions

GoMind may offer optional paid features through one-time purchases and auto-renewable subscriptions. Available products may include:

Prices, durations, and included features are shown in the purchase screen before purchase and may vary by region, currency, platform, and promotional availability.

4. Auto-Renewal, Cancellation, and Refunds

Subscriptions purchased through Apple renew automatically unless canceled at least 24 hours before the end of the current billing period. Your Apple ID account is charged for renewal within 24 hours before the current period ends. You can manage or cancel subscriptions in your Apple ID account settings.

For purchases made through Apple, billing, renewal, cancellation, and refunds are handled by Apple under Apple Media Services terms and App Store policies. GoMind does not store your payment card details.

5. Acceptable Use

You agree not to misuse GoMind, interfere with the service, attempt unauthorized access, reverse engineer the application except where permitted by law, upload unlawful content, or use GoMind in a way that violates applicable laws or third-party rights.

6. Cloud Sync and Account Features

If you use GoMind Cloud features, you are responsible for maintaining the confidentiality of your account credentials and for the content you choose to sync. Cloud sync is provided to help you access your mind maps across devices, subject to availability and maintenance.

7. Privacy

Our handling of personal data is described in the GoMind Privacy Policy. By using GoMind, you acknowledge that data may be processed as described there.

8. Updates and Changes

We may update GoMind to improve functionality, security, compatibility, or compliance. We may also change these terms from time to time. Continued use after changes means you accept the updated terms.

9. Disclaimer

GoMind is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We do not guarantee that GoMind will be uninterrupted, error-free, or suitable for every purpose.

10. Limitation of Liability

To the maximum extent permitted by law, Posh Limited is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or business opportunities arising from your use of GoMind.

11. Termination

We may suspend or terminate access to GoMind services if you violate these terms, misuse the service, or create legal or security risk. You may stop using GoMind at any time.

12. Governing Law

These terms are governed by the laws of Hong Kong SAR, except where local consumer protection laws require otherwise.
